Magnolia Properties follows a standardized, legally compliant screening process for every applicant. This ensures fair treatment, consistent criteria, and full protection for your investment property.
Our screening evaluates:
- Income Verification
- Employment and Stability
- Credit History
- Rental History
- Eviction Reports
- Background Checks
- Compliance with property policies, including pet and smoking rules
What We Can Legally Share With Homeowners
To keep our homeowners informed while maintaining strict compliance with federal and state laws, Magnolia Properties can share the following:
- Whether the applicant meets or does not meet each screening category
- Any conditions placed on approval (such as higher deposit)
- Final recommendation (Approved, Approved with Conditions, or Denied)
- General, non-sensitive information related to lease terms (such as pets, move-in timeline, etc.)
Examples:
- “Applicant meets income requirements.”
- “Applicant has acceptable credit history.”
- “Applicant meets rental and background standards.”
- “Applicant does not meet Magnolia’s minimum criteria due to income/credit/background.”
What We Cannot Share (By Law)
Federal privacy laws, including the Fair Credit Reporting Act (FCRA), restrict Magnolia from sharing personal or sensitive information with third parties, including homeowners.
We cannot share:
- Full credit reports
- Background check reports
- Criminal-record details beyond “meets/does not meet criteria”
- Employment verification documents
- Application data containing SSNs, dates of birth, bank information, or protected-class information
- Any sensitive personal or financial information
Why:
These documents are legally provided to Magnolia as the designated “end user” and cannot be redistributed. Sharing them exposes the homeowner and Magnolia Properties to legal and financial risk.
Homeowner Final Approval
Homeowners maintain final approval authority; however, decisions must be based on the results Magnolia provides, not the applicant’s personal consumer data.
You will receive:
- A summary of whether the applicant meets our screening standards
- Our professional recommendation based on those results
Legal Compliance & Fair Housing
All screening and approvals must be consistent with:
- Federal Fair Housing Act
- South Carolina Fair Housing Law
- Fair Credit Reporting Act (FCRA)
Magnolia ensures each applicant is evaluated identically to reduce liability and protect your property and our company.
